These Terms of Use apply in addition to:

• Any specific terms that apply to memberships, tickets, events or purchases
• Any terms of entry to competitions or promotions we run

Changes to these terms

We may change these Terms of Use from time to time. The latest version will always be available on the Website. By continuing to use the Website, you accept the updated terms.

Accessing the Website

Access is permitted on a temporary basis, and we may withdraw or amend the Website without notice, subject to your statutory rights. We may suspend access for maintenance or other reasons and are not responsible for the Website being unavailable for reasons beyond our reasonable control.

Your account and membership

You may need to register an account to use certain services. You are responsible for keeping your password confidential and for activity under your account. We may disable any account if we reasonably believe you have breached these Terms of Use.

Children

If you are under 18, you should use the Website with the involvement of a parent or guardian. Junior memberships and youth activities are intended to be registered and managed by a parent or guardian.

Our content and intellectual property

We grant you a limited, non-exclusive, non-transferable, revocable right to access and view the Website and its content for your personal, non-commercial use. You must not copy, modify, distribute, publicly display, or commercially exploit our content without our prior written consent, or remove any proprietary notices.

Trade marks

The name and logos "FC Nairobi", together with related marks, are trade marks owned by Typhoon Sports Group Ltd (Company No. 15740405) and used by FC Nairobi Ltd (company registration no. PVT-XYU8PD8X) under licence. They may not be used without our prior written consent. Other trade marks are the property of their respective owners.

Memberships, payments and purchases

Memberships and other purchases are subject to their own terms shown at the point of purchase. Prices are displayed in Kenyan Shillings (KES). Nothing in these Terms of Use affects your statutory rights as a consumer under the Consumer Protection Act, 2012, including your rights in relation to cancellation, refunds and redress. Please see our Membership FAQs for how these apply to memberships.

Content you upload

You must not upload content that is unlawful, infringing, obscene, abusive, misleading, or that disrupts the Website. You must not attempt to gain unauthorised access to the Website or interfere with its operation — conduct which may constitute an offence under the Computer Misuse and Cybercrimes Act, 2018.

Any content you submit is non-confidential; you retain ownership but grant us a worldwide, royalty-free licence to use it in connection with the Website and the club. We may remove content that breaches these terms.

Unacceptable content

If you find any content on our Website that you believe is offensive, obscene, defamatory, discriminatory, harmful, inaccurate, unlawful or otherwise in breach of our standards, please notify us at membership@fcnairobi.com with the subject "Unacceptable Content". We take complaints seriously and will investigate and, where appropriate, remove or block access to the content.

Linking to our Website

You may link to our home page provided you do so in a fair and legal way that does not damage or take advantage of our reputation. You must not link in a way that suggests any form of association, approval or endorsement by us without our prior written consent, and our Website must not be framed on any other site. We reserve the right to withdraw linking permission without notice.

Links and third-party sites

The Website may link to third-party sites or integrate third-party services. We are not responsible for their content or practices, and your use of them is at your own risk and subject to their own terms.

Disclaimers and liability

To the fullest extent permitted by law, we exclude implied warranties in relation to the Website and its content, and we are not liable for indirect or consequential loss. Nothing in these Terms of Use excludes or limits our liability for death or personal injury caused by negligence, for fraud, or for any liability that cannot be excluded under Kenyan law, including your statutory consumer rights.

Governing law and arbitration

These Terms of Use, and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with them or their subject matter, are governed by and construed in accordance with the laws of Kenya.

In keeping with Article 159 of the Constitution of Kenya (2010), which promotes alternative forms of dispute resolution including arbitration, any dispute arising out of or in connection with these Terms of Use, including any question regarding their existence, validity or termination, shall be referred to and finally resolved by arbitration under the Rules of the London Court of International Arbitration (LCIA), which Rules are deemed to be incorporated by reference into this clause.

The number of arbitrators shall be one. The seat, or legal place, of arbitration shall be Nairobi, Kenya. The language to be used in the arbitral proceedings shall be English. The governing law of this arbitration agreement shall be the substantive law of Kenya.

Nothing in this clause prevents either party from seeking urgent interim or injunctive relief from a court of competent jurisdiction, and nothing in it affects any statutory rights you have as a consumer under Kenyan law that cannot be excluded or limited, including any right to bring a complaint before a competent Kenyan authority.
